1. About these terms
These Terms of Use (the “Terms”) are an agreement between you and Colorkeet (“we”, “us” or “our”), the publisher of Colorkeet. They cover the Colorkeet app for iPad, its content (drawings, colored ideas, theme songs, sounds and voices), the content service the app connects to, and the Colorkeet Plus subscription (together, the “App”).
Colorkeet is made for children, but these Terms are for the parent or legal guardian who downloads and manages the App (“you”). By downloading or using the App, you accept these Terms for yourself and for any child who uses the App on your devices, and you’re responsible for that use. If you don’t agree, please don’t use the App.
Our Privacy Policy explains how we handle information. It’s part of these Terms.
2. Apple’s standard license agreement
The App is distributed through Apple’s App Store and licensed to you under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These Terms add to the Standard EULA. If anything in these Terms conflicts with the Standard EULA, the Standard EULA applies to the extent of the conflict. Section 16 explains Apple’s role.
3. Your license to use the App
As long as you follow these Terms and the Standard EULA, we give you a personal, limited, non-exclusive, non-transferable and revocable license to download and use the App on Apple devices you own or control, as the App Store’s usage rules allow, including Family Sharing where it’s available.
The App is licensed, not sold. We and our licensors keep all rights that these Terms don’t expressly give you.
4. No account needed
The App doesn’t use accounts or sign-in. The free drawings included in the App work without an internet connection. Downloading other drawings and theme songs, checking a subscription and receiving new collection alerts need a connection.
5. Colorkeet Plus
What Plus includes
Colorkeet Plus unlocks every drawing in every collection, including new drawings as they’re published, with unlimited downloads, unlimited colored versions of each drawing, and printing of coloring pages and colored artwork. Every tool, color, material and song is available with or without Plus, and there are no ads in either.
Price and automatic renewal
- Plus is an auto-renewing monthly subscription. It costs $4.99 a month in the United States; the App Store shows the price in your currency, including any taxes, before you confirm.
- Payment is charged to your Apple Account when you confirm the purchase or, if you start with a free trial, when the trial ends.
- The subscription renews automatically every month unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the current period ends.
- If the price changes, Apple tells you in advance and, where required, asks you to agree before the new price applies.
Free trial
- New subscribers can start with a 7-day free trial when the App Store offers it to their Apple Account. Apple decides who is eligible.
- Unless you cancel at least 24 hours before the trial ends, the subscription starts when the trial ends and your Apple Account is charged the monthly price.
- If the trial ends without a subscription, every Plus drawing downloaded during the trial is deleted from the device. Artworks colored on those drawings stay in My Art as images: you can view and share them, but not continue coloring them.
Managing and canceling
You can manage or cancel Plus at any time in your Apple Account’s subscription settings: in the App, open the parent area and tap Manage under Subscription, or on the iPad, open Settings, tap your name and then Subscriptions. Canceling stops future renewals; Plus stays available until the end of the period you’ve paid for. Deleting the App doesn’t cancel the subscription. Because Apple manages subscriptions, we can’t cancel one for you. Subscription help has step-by-step instructions.
When Plus ends
When a paid subscription ends, Plus drawings your child already started stay in My Art to view and share, but can’t be continued, and other Plus drawings are locked again. Free drawings and every tool, color and song stay available. Subscribing again unlocks Plus right away.
Purchases need a grown-up
Purchases in the App sit behind the parental gate, and Apple’s purchase sheet asks for authentication with your Apple Account. With Family Sharing, Ask to Buy applies. You’re responsible for purchases made with your Apple Account.
Restoring purchases
To use Plus on another iPad or after reinstalling, sign in with the same Apple Account and tap Restore purchases in the parent area.
6. Refunds
Apple processes all payments, so refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. We can’t see your payment details or issue refunds ourselves. Nothing in these Terms limits any refund or cancellation rights you have under the consumer laws where you live.
7. Content and what you can do with it
The drawings, colored ideas, theme songs, sounds, voices, characters (including the parakeet mascot) and the design of the App belong to us or our licensors and are protected by copyright and other laws.
Your child’s colored artworks combine their coloring with our drawings. For personal, non-commercial use, you may:
- keep, view and print them;
- share them, for example with family and friends or on your personal social media accounts;
- print coloring pages for your family to color at home.
You may not:
- sell, license or otherwise use the drawings, printouts, colored artworks, music or sounds commercially;
- republish or redistribute the drawings as coloring pages, for example in books, on websites or in other apps;
- copy or extract the App’s drawings, music, sounds or voices for use outside the App, including to train artificial intelligence or machine learning models.
We don’t claim ownership of your child’s coloring. Artworks stay on your devices and in your iCloud, and we never receive them.
8. Acceptable use
When using the App, you agree not to:
- copy, modify or create derivative works of the App, except as the law allows;
- reverse engineer, decompile or disassemble the App, except to the extent the law allows despite this restriction;
- bypass or interfere with the parental gate, the subscription checks, App Attest or any other security feature;
- access our content service other than through the App, or collect its content in bulk, for example by scraping;
- overload, disrupt or try to gain unauthorized access to our services;
- use the App in a way that breaks the law.
If an installation breaks these rules, we may stop it from using the content service.
9. Children and parental supervision
The App is designed for children aged 3 and up, including teens, set up and supervised by a parent or guardian. You choose your child’s age, which sets the look, the tools and the drawings, and you control the settings in the parent area.
Purchases, the parent area (settings), sharing, printing, deleting artwork and links that leave the App sit behind a parental gate. The gate is designed to keep young children from reaching these areas by accident; it isn’t a password or a security control. Please supervise your child’s use and protect your Apple Account, for example with Ask to Buy and Screen Time.
10. Changes to the App and its content
We may update the App, add or remove drawings and collections, change which drawings are free, or change features, to improve the App or for legal, safety or technical reasons. Drawings already downloaded stay on the device, except as described for the end of a free trial and when you clear downloads. Some updates may be needed to keep using the content service.
11. Availability
We work to keep the content service available, but it may sometimes be interrupted, for example for maintenance or because of problems with our providers. The drawings included in the App and those already downloaded keep working without a connection.
12. Disclaimers
To the extent the law allows, the App is provided “as is” and “as available”, and we don’t promise that it will always be available, uninterrupted or free of errors, or that it will meet every need.
Some countries don’t allow these disclaimers. If you’re a consumer, you keep the legal rights you have under the laws where you live, including any guarantees about digital content and services that can’t be excluded. Nothing in these Terms affects those rights.
13. Limitation of liability
To the extent the law allows:
- we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from or related to the App;
- our total liability for all claims related to the App is limited to the amount you paid for Colorkeet Plus in the 12 months before the event that led to the claim.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that can’t be limited or excluded by law.
14. Ending these Terms
You can stop using the App at any time by deleting it; cancel Plus separately in your Apple Account settings. We may end or suspend your license if you seriously or repeatedly break these Terms. Sections 7, 12, 13, 15 and 18 continue to apply after these Terms end.
15. Governing law and disputes
These Terms are governed by the laws of [Country or state], without regard to its conflict-of-law rules, and the courts of [Country or state] have jurisdiction over disputes about them.
If you’re a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts there. Before starting a claim, please contact us at hello@dodz.dev so we can try to resolve the issue informally.
16. Apple
You and we acknowledge that:
- these Terms are between you and us only, not with Apple, and we, not Apple, are solely responsible for the App and its content;
- Apple has no obligation to provide maintenance or support for the App;
- if the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App; to the maximum extent the law allows, Apple has no other warranty obligation regarding the App;
- we, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws;
- if a third party claims that the App or your possession and use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim;
- you confirm that you aren’t located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you aren’t on any US Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple may enforce them against you as a third-party beneficiary.
17. Changes to these Terms
We may update these Terms, for example when the App or the law changes. We’ll post the new version on this page, update the “Last updated” date and add an entry to the change log below. If a change significantly affects you, we’ll give reasonable notice before it takes effect. If you keep using the App after a change takes effect, the updated Terms apply. Changes to the price of Plus follow Apple’s process described in section 5.
18. General
These Terms, the Standard EULA and our Privacy Policy are the whole agreement between you and us about the App. If a court finds part of these Terms unenforceable, the rest stays in effect. If we don’t enforce a right straight away, we don’t give it up. We may transfer these Terms to someone who takes over Colorkeet, as long as your rights aren’t reduced; you may not transfer them without our consent.
